1. AGREEMENT TO TERMS By accessing, browsing, registering, bidding, or consigning a vehicle on this website, you agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using or accessing this platform.

2. ELIGIBILITY & BIDDER REGISTRATION

  • Account Requirement: To participate in active bidding or consign a vehicle, you must create a registered account and provide accurate, current, and verifiable personal identity data.

  • Identity & Bidder Verification: To safeguard platform integrity, we reserve the right to perform identity verification checks, including government ID validation and credit checks.

  • Pre-Authorization Holds: Before placing a bid on a high-value or supercar listing, a temporary credit card pre-authorization hold may be processed via Stripe. This hold is released immediately if you are not the winning bidder.

3. AUCTION PROCESS & BIDDING RULES

  • Binding Bids: Every bid placed on the platform is a legally binding offer to purchase the vehicle at the stated amount. Bids cannot be canceled, lowered, or retracted once submitted.

  • Reserve Prices: Most auction lots feature a confidential reserve price agreed upon between the seller and our specialists. The listing will clearly state whether the reserve price has been met.

  • Anti-Sniping Clock Extensions: To ensure a fair marketplace, if a bid is placed within the final minutes of an auction, the automated bidding clock will automatically extend by a set increment to allow counter-bids.

  • Winning Bid & Buyer’s Premium: When the virtual hammer drops, the highest bidder whose bid meets or exceeds the reserve price is legally obligated to complete the purchase. The buyer agrees to pay the final hammer price plus any applicable Buyer’s Premium calculated at checkout.

4. CONSIGNMENTS & SELLER OBLIGATIONS

  • Curation & Accuracy: Sellers warrant that all information, history, documentation, and images provided for a listing are truthful, complete, and accurate.

  • Exclusive Right to Sell: By submitting a vehicle for consignment, the seller grants the platform an exclusive listing period. The vehicle may not be offered for sale elsewhere while active on the platform.

  • Title & Encumbrances: Sellers guarantee they hold a clear, legal title to the vehicle (or explicit authority to sell) free of un-disclosed liens, encumbrances, or legal disputes.

5. PAYMENT, INVOICING & FINALIZATION

  • Invoices: Upon winning an auction, WooCommerce automatically generates an acquisition invoice detailing the final bid, buyer’s fee, and payment instructions.

  • Wire Transfers & Payment Deadlines: Unless explicitly stated otherwise, final vehicle balances must be settled via certified bank wire transfer within three (3) business days of auction completion.

  • Default: Failure to complete payment within the designated timeframe constitutes a default. The buyer forfeits any pre-authorization holds, may be subject to liquidated damages, and faces permanent suspension from the platform.

6. INSPECTIONS & DISCLAIMER OF WARRANTIES

  • As-Is Sale: All vehicles are sold “As-Is, Where-Is” without warranties of any kind, express or implied, by the platform.

  • Due Diligence: Buyers are solely responsible for performing their own due diligence, reviewing provided service records, inspecting high-resolution photo galleries, or scheduling a pre-purchase inspection prior to placing a bid.

7. TRANSPORTATION & TITLE TRANSFER

  • Logistics: Buyers are responsible for arranging and funding vehicle transport and export/import duties following cleared payment. The platform may assist by recommending third-party insured transport partners.

  • Title Hand-Off: Title transfer and physical vehicle release occur directly between the buyer and seller once all funds have fully cleared through bank escrow or wire transfer.

8. LIMITATION OF LIABILITY The platform serves as a curated marketplace facilitating transactions between independent buyers and sellers. We are not liable for any indirect, punitive, incidental, or consequential damages arising from site downtime, bidding software glitches, vehicle description errors, or breach of contract by either buyer or seller.

9. MODIFICATIONS & GOVERNING LAW We reserve the right to modify these Terms & Conditions at any time. Changes take effect immediately upon posting to the site. These terms shall be governed and construed in accordance with the applicable laws of the operating jurisdiction, without regard to conflict of law principles.
